even if he can, he can't prove there is any consideration for the waiver of the original debt - the exception is factual benefit but there is none here. even despite the promissory estoppel defense, he can't prove as you say the phone call - there again is also no factual benefit for him if he were to have relied on the promise.. it would also be unreasonable in a matter as trivial as this, for the courts to believe promissory estoppel a valid defense. so ye i think he is pretty foofed if it were an english court - the entire thing is pretty fucking sad as well. =\
